Acceptance of terms

The services that Mi-Pay provides to you are subject to the following Terms and conditions. Mi-Pay reserves the right to update the Terms and conditions at any time without notice to you. You can view the most current version of the Terms and Conditions by clicking on the “Terms and Conditions” hypertext link located at the bottom of our Web pages. By accessing, browsing, or registering to use our site, you are agreeing with these terms and conditions.

 

Description of Services

On behalf of your Telecommunications Service Provider, Mi-Pay provides a payment gateway website through which you can order and/or make payments for goods and services purchased from your Service Provider. This Agreement sets out the terms on which you can use this website.

By using this service, you authorise us to take the relevant payment from your chosen payment instrument, which you have provided. We then receive your payment as an agent of your Service Provider and are responsible for passing it to them.

 

Privacy and protection of Personal information

We are committed to protecting your personal information and undertake all necessary actions in order to comply with GDPR legislation and any other applicable requirements.

Mi-Pay will never ask for sensitive information from you outside of this website. Never send sensitive information such as bank account, full credit/debit card number, expiration date, CVV, personal address, etc. outside of this website.

For the purpose of authentication and in compliance with GDPR regulation, we may ask for a proof of ID from you. Only use the secure links that have been provided to you for such purpose, never send these type of documents via email.

 

Member Account, Password and Security

You are responsible for maintaining the confidentiality of your account. During the registration process, you will use your Service Provider Username and Password or you will need to create a Mi-Pay username and password. If your Service Provider offers SMS and IVR facilities via Mi-Pay, you may also need to create an SMS and a IVR PIN number upon registering with Mi-Pay as a new user. You should take all necessary steps to ensure that your username and password and/or PIN are kept confidential and secure at all times.

You are entirely responsible for all activity that occurs on your account. You agree to notify your Service Provider immediately if you have any reason to believe that an unauthorised person knows your password or PIN, or your account is either used or likely to be used in an unauthorised way. Mi-Pay will not be liable for any loss incurred by you because of someone else using your password or PIN or account, with or without your knowledge.

If we have reason to believe there is a security breach, or misuse of your account has occurred or is likely to occur, we may suspend or close your Mi-Pay Account.

If your account is no longer in use for more than two years, the account will be automatically suspended. If no request is made to re-open your account two years after it was suspended, the account will be terminated and all personal data associated with it will be removed.

 

Links

This site includes links and automated redirects to other web sites, websites that are completely independent. Automated redirects are included for the purpose of validation, authentication, and completion of transactions (Card issuing bank 3DS website, electronic wallet website such as PayPal, Amazon pay, Apple Pay, etc.). We accept no responsibility, and we do not endorse the content of any third-party websites.

 

Use of Services

You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way, which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose of activity.

You must not use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or linked to) any malicious computer software (e.g. spyware, computer virus and other).

You agree not to modify, move, add to, delete or otherwise tamper with the information contained on the website. In addition, you agree not to decompile, reverse engineer, disassemble or unlawfully use or reproduce any of the software, copyrighted or trademarked material, trade secrets, or other proprietary information contained on the website.

We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending or terminating service, denying access and/or removing any materials from the Website). We may also investigate, on our sole discretion, the use, or attempted use, of any credit card, and take action, as we deem appropriate, including without limitation, contacting the User using such a card or cancelling orders placed by such a User.

 

Limitation of Liability

You may not always be able to access this Website. We are not responsible for any losses if you cannot do so (for example, if you cannot obtain a product at a stated price). We are not responsible if the means of communication you use to access the Website or to send us information about yourself or to receive information from us does not work properly.

We advise you to check a product or service carefully before you agree to buy it, and we are not responsible for any losses you may suffer if you fail to do so unless information we put on the Website was incorrect or misleading (and provided the correct information was not provided to you or made available before you completed your purchase).

We take reasonable care to ensure the accuracy of information provided on third-party websites (outside the Mi-Pay Ltd.) which we may have linked through this Website, as we cannot control what they contain, we are not responsible for any losses or other damage you may suffer as a result of using those other websites.

We are not liable for losses or costs caused by abnormal and unforeseeable circumstances outside our reasonable control, which would have been unavoidable despite all efforts to the contrary, for example delays or failures caused by industrial action, problems with another system or network, third-party viruses or malware, mechanical breakdown or data-processing failures.

Please remember that email is not a completely secure means of communication: it may be possible for others to intercept and read your messages. If you choose to send us information by email, it is at your own risk.

 

General

We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms. In case of such an occurrence, we will always notify you in writing or by posting the relevant information on this webpage.

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

Mi-Pay reserves the right to discontinue or modify any aspect of the Site at any time.

These terms and conditions will be governed by and constructed in accordance with English law, and any disputes relating to these terms of use will be subject to the exclusive jurisdiction of the courts of England and Wales.
